In a case investigated by the West Yorkshire Financial Exploitation and Abuse Team, part of West Yorkshire Trading Standards, Garry FREEMAN 69 years of age of Park Croft, Pudsey, was sentenced on 30/01/2025 at Leeds Crown Court after pleading guilty of defrauding his elderly and vulnerable mother of £77,490.41 whilst she was residing in a care home. Freeman was subject of a criminal investigation by West Yorkshire Financial Exploitation and Abuse Team (WYFEAT), on behalf of Leeds City Council Adult Social Care, which uncovered the financial abuse.
In March 2020, social care staff from Leeds Council shared their financial concerns with the Office of Public Guardian and WYFEAT that the legal power of attorney Freeman was abusing his position and using the victim’s money for his own financial gain. This resulted in the victim being in significant arrears with care home fees and facing eviction.
WYFEAT undertook a criminal investigation into these financial concerns and discovered that Freeman was not fulfilling his role as his elderly mother’s Lasting Power of Attorney and instead he was systematically financially misappropriating her money and savings for his own gain and personal use. Freeman would use his mother’s card to pay for family meals, dating websites, fast food restaurants, travel, flower delivery companies and using her bank card during holidays abroad, whilst his mother was residing in a care home and did not benefit from the purchases. The care home reported that Freeman would not visit the victim often and provided her with little money for personal allowance whilst he was using her money to enjoy luxuries.
The total amount of the money taken was £77,490.41. In addition to this amount, it was found that his mother’s care home fees were in considerable arrears, meaning that her placement was at risk and could have resulted in eviction. Freeman showed no regard to this and the risks he posed to her.
During the sentencing hearing at Leeds Crown Court, Freeman received a suspended sentence of 24 months and costs of £33,445.23 and a victim surcharge, he was sentenced for three counts of S4 Fraud Act 2006, abuse of position in line with his role as his mother’s Lasting Power of Attorney and one count of S2 Fraud Act 2006, fraud by false representation.
Freeman pleaded guilty to all four counts on Friday 22nd November 2024 at Leeds Crown Court and this early guilty plea was taken into consideration by His Honour Judge Batiste today at Leeds Crown Court.
Freeman’s offending spanned a period of four years from August 2016, only coming to an end in March 2020 when WYFEAT began its criminal investigation.
At the time, Freeman’s elderly mother was a resident in a care home in Pudsey owing to numerous health concerns. At the time she was 87 years of age and had a confirmed diagnosis of Alzheimer’s and had a heart condition.
His mother had no knowledge of the ongoing financial exploitation and abuse being committed against her by her own son, owing to her lacking capacity due to her Alzheimer’s. When Freeman’s offending was exposed, and he was interviewed by WYFEAT, he claimed that the fraudulent money transactions that he had actioned were with the full consent of his mother despite her being unable to consent and her placement being at risk. Freeman also sent an email in error to Leeds City Council admitting his offending which he later denied in interview.
In His Honour Judge Batiste’s summing up, his comments were noted in Freeman’s sentencing ‘Mary Freeman was your mother and appointed you and trusted you with her finances, and to treat her money as your own is a gross breach of trust. You were not entitled to do that. You took control and syphoned her money away and tried to cover your tracks.’
Linda Davis, Head of West Yorkshire Trading Standards (Protecting Communities) said ‘Garry Freeman was in a significant position of trust, and he abused that position using his mother’s money to finance his own lifestyle whilst she was in a care home and not getting any benefit from the money. The WYFEAT investigation on behalf of Leeds City Council clearly evidenced financial abuse and fraud by abuse of position and the sentencing today should serve as a warning that fraud of the most vulnerable people in our society will not be tolerated’.
A Leeds City Council spokesperson said: “This was a gross abuse of trust by Gary Freeman against his elderly and vulnerable mother.
“Our social care team took swift action as soon as it became clear there were financial concerns around his behaviour as power of attorney.
“In selfishly choosing to use these funds for his own financial gain, Freeman showed an abhorrent disregard to the significant responsibility he held in relation to his mother’s needs and we’re pleased the sentence reflects the serious nature of these offences.
“We will not tolerate abuse of any kind against vulnerable people and will always take action to root this out. Sadly, perpetrators of abuse or neglect are often people who are trusted and relied upon by an older person so would urge everyone to be alert to any signs of possible mistreatment.
